By paying to reveal a square of the Work and/or accessing the Website, you hereby accept and agree to the below terms and conditions (the Terms and Conditions or T&Cs) without any reservation, condition or restriction. You will not access the Website for any purpose that is unlawful or prohibited by these Terms and Conditions.
By paying an amount of [£X], a square of the Work will be revealed to you. Upon all of the squares being revealed, the entire Work will be revealed. The NOcado Campaign reserves the right to reveal the entire Work ahead of all of the squares being revealed. If you have paid to reveal a square of the Work, you will receive an email confirmation of your payment from Stripe, our payment processor. All paying donors will receive an email with a high resolution digital image of the Work upon it having been revealed. We will endeavour to send this email within one month of the full Work being revealed.
By paying to reveal a square, no ownership or intellectual property rights or interests or rights are conferred on you and no non-fungible token is hereby created, granted, vested or otherwise transferred to you or any other person or entity. All rights in the Work or any part thereof, together with any right to copy, change, sell, transfer, transmit, COMMERCIALISE or profit from the Work will be retained by Mark Wallinger.
All MEMBERS OF THE PUBLIC, WHETHER PAYING PARTICIPANTS OR OTHERWISE, SHALL HAVE THE OPPORTUNITY TO ENTER IN TO A FREE DRAW to win a limited edition signed print of the Work. 20 copies of the limited edition print WILL BE randomly allocated to ENTRANTS OF THE FREE DRAW. The result of the FREE draw is final. We will endeavour to send out final prints within one month of the full Work being revealed. Further terms specifically with respect to the raffle draw are set out below:
ENTRY IN TO THE FREE DRAW FOR A SIGNED PRINT IS SEPARATE AND DISTINCT FROM PARTICIPATION IN THE WORK BY PURCHASING A SQUARE.
The NOcado Campaign accepts no responsibility for confirmation emails that are lost or not received or provided addresses that are incorrect. Please ensure you enter your email address accurately. WINNERS WILL BE CONTACTED BY EMAIL TO ARRANGE POSTAGE OR COLLECTION (AS APPLICABLE) OF THE PRINTS
Failure to comply with any of these rules may result in the disqualification of the entry. Organisers reserve the right to disqualify any entry at their absolute discretion.
The Website and the Work is provided or revealed, as applicable, on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty or representation of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
To the extent permitted by law, neither NOcado Campaign or Mark Wallinger will be liable for any loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website and/or participation in the revealing of the Works.
The NOcado Campaign makes no warranty or representation that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or malware or anything else which may be harmful or destructive.
Occasionally there may be information on the Website that contain typographical errors, inaccuracies, and/or omissions. We reserve the right to: (i) revoke any stated offer; (ii) correct any errors, inaccuracies, and/or omissions; and/or (iii) make changes to prices, content, promotion offers, service and/or product descriptions, specifications, and/or other information without obligation to issue any notice of such changes.
By participating in the revealing of the Works, you agree and authorise the Campaign to share, if and when necessary, the personal data that you have provided with our payment service provide for the sole purposes of processing the payment. Besides, the purchaser acknowledges that the Campaign may be required to provide such data to any regulatory bodies or administrative authorities if required by law.
The NOcado Campaign shall have absolute discretion to exercise its right to alter these Terms and Conditions as and when it sees fit or to alter or change the manner in which the Work is revealed OR THE GIVE AWAY IS STRUCTURED. Such changes will take place upon the updated Terms and Conditions being uploaded to the Website and will be final and binding on the Parties. In the event of an error, howsoever caused, whether technological or otherwise and whether obvious or otherwise, which affects the SALE OR THE GIVE AWAY in any way, the organisers reserve the right to fairly administer the SALE OR THE GIVE AWAY as though the error had not occurred. Where the organisers deem it appropriate and/or feasible NOcado Campaign will notify entrants of the error.
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
These Terms and Conditions shall be governed by and construed in accordance with the laws of England & Wales and you hereby submit to the exclusive jurisdiction of the English courts.
